Terms of Service

§1 Scope
These General Terms and Conditions (GTC) apply to the use of the platform datemydata (available at datemydata.com) and all associated APIs and services (collectively "Service"). By registering, the user accepts these GTC.
§2 Service Description
datemydata is a Software-as-a-Service platform. The Service enables users to connect their own data sources (files or databases) and query and analyze them using an AI-powered chat interface in natural language.
§3 Data Access and Storage
3.1 Principle
Protecting user data is datemydata's highest priority. The following provisions are binding service commitments.
3.2 SQL Database Connectors
When connecting an external database (PostgreSQL, MySQL, MSSQL, etc.):
- —datemydata establishes a direct connection to the user's database.
- —Only structural metadata (table names, column names, data types, relationships, statistical metrics without data values) is cached on datemydata's servers.
- —Query results are used to process the respective user request and may be stored as answer artifacts, export sources or intentionally shared snapshots. They are deleted with the related message, conversation, project or account; public shares can be revoked or expire.
- —Connection parameters (credentials) are stored exclusively in encrypted form (AES-256-GCM) and are never processed or transmitted in plain text.
3.3 File Uploads
Uploaded files (CSV, Excel, etc.) are temporarily stored encrypted on EU servers to enable structural analysis. After successful indexing, original files are deleted within 24 hours.
3.4 Explicit Prohibition of Data Sharing
Contents of database tables (data values, personal data, transaction data, etc.) are not by datemydata:
- —copied as a complete live-database replica,
- —used for purposes other than the immediate response to a user query,
- —transmitted to third parties — including AI providers — as permanent data storage,
- —used for training AI models.
3.5 AI Processing
To answer user queries, selected schema context, metadata, tool inputs, query results and optional document/vector snippets may be temporarily transmitted to the configured AI provider (for example Anthropic, OpenAI or Google). These providers process the data exclusively to provide the API service and do not use it to train their models under the configured business API terms. Stored embeddings and derived indexes are deleted with the related project/source or account retention process.

§4 Terms of Use
4.1 The user is solely responsible for the legality of connected data and compliance with applicable data protection laws (in particular GDPR/DSG).
4.2 The Service may not be used for unlawful purposes or for processing special categories of personal data (Art. 9 GDPR) without an appropriate legal basis.
4.3 Automated scraping or misuse of the API is prohibited.
§5 Subscriptions and Payment
5.1 Subscriptions are billed monthly or annually in advance. They renew automatically for the booked period unless cancelled before the end of the term.
5.2 Cancellation is possible at any time via the account portal and takes effect at the end of the current billing period.
5.3 Credits are tied to the billing period and expire at its end, unless rollover is provided per plan conditions. Credits from top-up purchases do not expire (exception: account deletion).
5.4 Top-up purchases are non-refundable once credits have been used.
5.5 In case of payment default, datemydata reserves the right to suspend access to the Service after a reasonable period.
§6 Availability and Support
6.1 datemydata aims for a monthly availability of 99% (excluding planned maintenance windows and force majeure events).
6.2 A contractual right to credits or damages for failure to meet availability exists exclusively for Enterprise customers with an individual SLA.

§7 Intellectual Property
The Service including all software components, trademarks, and content is the property of datemydata. The user is granted a simple, non-transferable right of use for the duration of the subscription.
§8 Limitation of Liability
8.1 datemydata's liability is limited to direct damages up to the amount of the subscription fee paid in the relevant calendar month.
8.2 Any liability for indirect damages, consequential damages, lost profits, or data loss is excluded to the extent permitted by law.
8.3 Analyses and responses from the Service are AI-generated and may contain errors. They do not replace professional advice.
§9 Term and Termination
9.1 The contract runs for an indefinite period and may be terminated by either party with immediate effect for good cause or ordinarily at the end of the billing period.
9.2 datemydata may suspend or terminate the account in case of violation of these GTC or payment default after a reminder.
§10 Changes to the GTC
Changes will be announced to the user by email with 30 days' notice. In case of material changes, the user has an extraordinary right of termination.
§11 Applicable Law and Jurisdiction
Swiss law applies, excluding international private law and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for disputes is Zurich, Switzerland.
